IP/IT Law
Our firm permanently advises our clients in matters involving IP or IT. Here are a couple of recent examples :
- General IP law : We assist our clients during a sale
or an acquisition of a company, either by preparing all IP/IT related documents and files of the dataroom
or by performing the due-diligence review of such documents, for instance during the acquisition of French
group by a Swiss listed company in the luxury business, or more recently during the divestment by a US
listed company of one of its branches in the automotive industry or the sale of the going concern of
a German listed pharmaceutical company.
- Copyright : We represent our clients
during trials for copyright infringement before French courts, for instance during a lawsuit between
a French manufacturer of toys against a German competitor which had copied several models, or for
the developer of a new original version of a famous sportscar model from the 1970s.
- Patent law : We represent our clients
before the French courts during the preparation phase (planning and execution of seizures on the
French territory) and during trials for patent infringement and unfair competition, on behalf of the
plaintiff for instance for a German manufacturer of military vehicles against his competitor which had
presented infringing products during a fairshow, for a manufacturer of plastic containers against a
competitor selling patent infringing products in France, for a US listed corporation manufacturing
air-conditioning equipments against his Japanese competitor and his French distributor, as well as
for the defense of a German manufacturer of coin deposit locks for supermarket trolleys against a
French competitor in a multimillion euros case or for a German manufacturer of chipcard reading
systems against a competitor.
- IT Law :
We frequently represent our clients before courts or specialized arbitration institutions in case of
domain names hijacking, recently for the French leading company in GSM networks quality auditing, but
we also assist clients for the negociation of complex software licensing agreements, for instance a US
listed company leader for mail processing softwares or the subsidiary of a major US listed company
selling compliance solutions and softwares for the financial and banking industry.
